Public procurement in Romania · for EU and non-EU companies

Your Romanian tender office — from the SEAP opportunity to the final payment certificate

We run Romanian public tenders end to end for international companies: eligibility, the Romanian qualification file, technical and financial proposals written in Romanian, submission in SEAP, clarifications, remedies — and, after the award, works valuation through to the final payment. You decide in English. We deliver inside the Romanian system.

  • Upload the procurement data sheet or the TED notice for an indicative fee in about a minute — or send us the notice and your deadline and receive a free one-page Go/No-Go snapshot within 2 working days. No obligation.

01Why foreign bids fail in Romania

In Romania, most tenders are lost on procedure, not on price

Romanian public procurement is fully electronic, heavily formalised and conducted in Romanian. A technically superior bidder can be removed for an incomplete ESPD, a missing certificate or a document signed with the wrong signature. A local desk removes those risks before they cost you the contract.

  • One platform, one way in.

Every procedure runs through SEAP, the national e-procurement system at e-licitatie.ro: registration, clarifications, submission, the encrypted financial offer and the award decision. Even when you find the notice in the EU's TED, you bid in SEAP.

  • Formalism that removes good bidders.

An incomplete ESPD (DUAE), a missing certificate, an unsigned form or a guarantee worded differently from the model is enough to eliminate a bid. Evaluation committees apply the procurement data sheet (Fișa de date) literally.

  • Romanian, from first page to contract.

Bids, clarifications, correspondence and the contract are in Romanian. Foreign documents need authorised translation and, often, an apostille.

  • Deadlines counted in days.

Clarification, response and remedy deadlines are short and run from publication in the platform, in Bucharest time.

  • EU funding layers.

Cohesion programmes, the Modernisation Fund and other EU instruments add eligibility, "do no significant harm" and reporting conditions on top of procurement law.

  • Regulator and audit.

The National Agency for Public Procurement (ANAP) checks selected award files, and managing authorities and auditors re-check them long after signature. Your file has to survive both.

The other side of the coin: competition is thinner than you think. In 2024, 44% of Romanian procedures received a single bid (EU average: 28%), and 82% were awarded on price alone (EU average: 54%). A well-prepared foreign bidder often faces fewer competitors than expected — and a financial offer that is built and documented properly decides the outcome.

What you get

One accountable desk inside the Romanian system

  1. One point of contact, working in English. A designated bid manager who answers for the whole file — not a chain of subcontractors.

  2. A bid built to survive evaluation, not just to be submitted on time: every requirement of the data sheet is mapped to evidence, an owner and a deadline.

  3. Prices you approve, backed by a cost structure we can defend in writing — including the justification file if the authority questions an abnormally low price.

  4. Proposals written directly in Romanian. You approve English working versions, so you do not pay to translate the heaviest part of the bid.

  5. Continuity after the award: contract signature, guarantees, interim payment statements, variations and, where needed, remedies.

How a mandate runs

One standard sequence. Nothing moves on until you sign off.

  1. Identify

SEAP and TED screening against your profile · Go/No-Go memo · bid plan and calendar

  2. Build

document collection · eligibility and ESPD · technical proposal · financial proposal

  3. Submit

quality control and compliance review · submission in SEAP at least 24 hours before the deadline · clarifications

  4. Deliver

award and contracting · guarantees and works valuation · remedies, if needed

Governing principle: you approve every commercial value in the offer. We are accountable for compliance, for coherence between the qualification, technical and financial parts, and for on-time delivery into the platform.

Your first 30 days with a Romania Tender Office

  1. Week 1 — Mandate and set-up.

Kick-off, conflict-of-interest screening and NDA. Your sectors (CPV codes), capacity and target regions defined. SEAP account and qualified e-signatures started.

  2. Week 2 — Document vault.

Corporate, financial, experience and personnel evidence collected once. Translations and apostilles started. First shortlist of opportunities.

  3. Week 3 — First decision.

Go/No-Go memo on a live procedure, with compliance matrix and risk register. Participation structure agreed. Bid plan with internal deadlines.

  4. Week 4 — First submission.

Qualification, technical and financial parts built, checked and submitted in SEAP, with proof of filing.

If a procedure is already open when we start, the Go/No-Go and the document vault run in parallel from day one.

  • Georgiana Lazăr

Jurist and public procurement expert, focused on the legal side of procurement and remedies.

Covers the legal side of procurement: award documentation and contract review, clarifications, points of view and CNSC complaints, together with the licensed attorneys we coordinate where representation is mandatory.

A permanent core team of four experts, plus vetted external specialists: structural, MEP, civil and geotechnical engineers, quantity surveyors and cost estimators, planners, licensed attorneys and authorised translators.

Three practices, kept apart

  • Bidder side — your Romania Tender Office:

opportunity monitoring, Go/No-Go, qualification and ESPD, technical and financial proposals, submission, clarifications, award, remedies.

  • Cost engineering and works valuation:

priced bills of quantities for the bid, then interim payment statements, variations and final settlement — one audit trail from submission to final payment.

  • Authority side:

for contracting authorities and project units, on separate mandates; also a procurement workflow platform through our partnership with ProcessPlayer.

Mandates on the two sides of the market are screened for conflicts of interest and kept strictly separate. We never act for a bidder in a procedure we have worked on for the contracting authority. Confidentiality undertakings are signed before any documentation is exchanged.
